In March 2006, a settlement was reached involving three (3) trucking companies in what has been described as a “hotly” contested dispute over liability between the motor carriers. The defendants settled with the parents of the pregnant mother for $12,000.000.00. The parents of the pregnant mother also made a claim for the loss of the fetus. Although the issue of whether the “grandparents” had a viable claim for the loss of the fetus was not resolved by the Court, the defendant trucking companies settled that particular claim for $2,475,000.00. Under Missouri law, the “parents” can make a claim for death and injuries to a fetus. The case was pending in Jackson County, Missouri (Kansas City, Mo.).
